USER

The user declares that they are of legal age (18 years) and possesses the necessary legal capacity to contract the products offered on the website in accordance with the conditions outlined below, which they declare to understand and accept.

The user is responsible for providing their data correctly during the contracting processes established on the MACSON website, paying special attention to the introduction of personal, banking, and delivery details of the order.

The user commits not to engage in the following behaviors, which constitute criminal acts punishable by law:

Providing false information about the buyer or the card number used as a means of payment.

Using data from persons other than the buyer.

Usurping the condition of holder of foreign cards.

Using card numbers generated by computer programs or similar algorithms.

MACSON is not responsible for the truthfulness and accuracy of the data filled in by the user and for this reason will not assume any responsibility for individuals who violate the regulations.

By registering on the MACSON website, the user will choose a password that will later be confirmed via email. The user must duly safeguard the keys and passwords provided for their access as a registered user, as they are personal and confidential, and the user is responsible for their use by a third party due to a breach of their duty of custody.

MACSON reserves the right to cancel a user's access account if fraudulent, speculative, or bad faith acts are detected in the use of this service.

PURCHASE PROCESS

The purchase process is as follows:

a) Selection of Products

You can choose the product by clicking on the desired image, where you can view its characteristics in more detail by opening the product sheet (size, quantities, colors, etc.). Products must be added to the cart, and once you have completed your selection, which you can repeat as many times as you wish, you will click "Finalize Order" to continue formalizing your purchase.

b) Registering Your Data

To make a purchase, you can identify yourself as a user of the platform with your email and password, create a new user at that moment, or, if you prefer, purchase as a guest, providing only the strictly necessary data to manage your order.

c) Delivery Details

Choose the option that is most convenient for the delivery of your order. You can enter a delivery address at the point you wish or collect it at any of our stores. The platform will calculate the shipping costs depending on the area or country of shipment.

d) Payment

Accepted payment methods include credit cards (Visa, MasterCard, American Express, and Bizum) and through the PayPal system. Fill in the necessary fields corresponding to the chosen payment method, with the option to request an invoice by filling in the tax details.

e) Order Confirmation

Please check that all details of your purchase are correct (products, characteristics, quantities, delivery location, total amount, etc.) by clicking "Finalize Purchase" to formalize your purchase. Once your purchase request is received, MACSON will proceed to review and verify that it meets all requirements for processing. You will then receive an email in which MACSON confirms that your order has been placed.

f) Receipt of Purchase Ticket

Upon receipt of the product, a printed copy of the purchase ticket will be included.

PRODUCT AVAILABILITY

All orders are subject to product availability, so if there are issues regarding their supply or if products are out of stock, the customer will be immediately informed, and a refund of the amount for the out-of-stock product(s) will be processed.

If a product is unavailable, but others in the same order are, the user will be informed by phone or email of the cancellation of only the unavailable products. The rest of the order will continue to be processed so the customer can receive it as soon as possible.

PRICES

The applicable prices are those indicated on the website on the date of the order.

The company reserves the right to change prices without affecting, except as mentioned below, orders made prior to and formalized by us with the "Confirmation of Shipment".

The prices of our products are expressed in euros and include VAT (Value Added Tax).

The prices of our products exclude any possible expenses that may arise depending on the shipping conditions. The final price of each order will be reflected in the purchase summary before finalizing the payment, always considering that shipments of orders over €80 to the Peninsula and Balearic Islands are free.

If MACSON occasionally and absolutely unintentionally makes a technical or human error and assigns an incorrect price to a product, reasonably foreseeable or detectable as such by the user, and the product with the incorrect price is purchased by the user, they will be informed as soon as possible and may choose to either reconfirm their purchase at the correct price or cancel it. However, if it is not possible to contact the customer, the order will be considered canceled, and the user will be refunded the entire amount paid.

The company will not be obliged to supply any product at an incorrect lower price (including after the "Confirmation of Shipment") if the pricing error is obvious and unmistakable and could reasonably have been recognized by the user and/or the company.

OFFERS, PROMOTIONS, AND DISCOUNT CODES

Macson’s offers, promotions, or discount codes are non-cumulative and are limited to one per person and per order unless stated otherwise. Only one discount code can be used per order and shopping cart.

Discount codes are non-refundable and cannot be exchanged for cash, and in the event of a return or exchange, the value of the code or promotion will not be refunded.

If you have a promotional code, you can use it before finalizing your order in the ‘Order Summary’. Enter the promotional code in ‘Add Gift Voucher’ and click ‘Validate’. If the discount code is valid, you will see the discount applied to ‘My Purchase’ on the right side of the screen. If the code can be used in a physical store, show the code at checkout for it to be applied to your purchase.

PAYMENT METHODS

All transactions are carried out through a secure payment system, and the confidential payment data is transmitted directly and encrypted to the entity responsible for the collection.

The payment methods that can be chosen to formalize purchases through our website are as follows:

Credit bank cards: Visa, Mastercard, American Express.

PayPal System (you will be redirected to the PayPal page to make the payment).

Bizum.

In any case, the choice of payment method is made during the purchase process on the corresponding screen, and depending on the chosen payment option, you will access the necessary fields to formalize the payment for your purchase.

Providers or issuers of payment methods may adopt anti-fraud measures that lead to the rejection of certain types of operations. MACSON is not responsible for the application of such security policies.

Payment will be made at the end of the purchase process and will be a prerequisite for formalizing the transaction. In no case can payment be made afterward. Payment through deferred procedures, such as cash on delivery or bank transfer, is not accepted.

SHIPPING AND TRANSPORT

Shipments to Spanish mainland territory and the Balearic Islands will be free for orders over €80. For orders sent to mainland territory and the Balearic Islands below €80, the shipping costs are €6,49. The website will calculate shipping costs outside of the mainland and the Balearic Islands.

Shipments will be made once product availability is confirmed and payment is confirmed.

The estimated delivery time in Spanish mainland territory is 24 to 48 hours*, from Monday to Friday, for orders placed on business days. In the Spanish insular territory, Ceuta, and Melilla, the estimated time is 48 to 72 hours*, from Monday to Friday, for orders placed on business days.

*During the Sales season and Outlet products, deliveries may be delayed.

However, MACSON will strive to adhere to this timeframe and will not be responsible for exceeding the initially estimated timeframe for any reason. Shipments to the Canary Islands, Ceuta, and Melilla, and to other territories outside Spain are not free and will have a specific cost indicated at any moment in the purchase process; these expenses are paid in advance in the purchase process through the payment methods established on this website. Regarding the delivery time, you will also find the timeframes during the purchase process, which will be determined by the transport companies. Purchases can be received at any address as long as it is not a post office box.

MACSON is not responsible if the delivery addresses are incorrect or incomplete. You can place your order and set a delivery address different from your personal data. This way, we aim to offer you the greatest ease and convenience possible. You can check the status of a shipment through the Outvio platform, where you will see all the information regarding your order reflected and updated.

If delivery cannot be made due to the recipient's absence, the transport agency will leave an indication note and will try to contact the recipient by phone. After a failed attempt, the customer must contact the transport agency to proceed with the delivery.

The "Pick&Collect" service is also available at any of our stores.

ONLINE DISPUTE RESOLUTION

In accordance with Article 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for online dispute resolution between the customer and the brand, without the need to go to the courts of justice, through the intervention of a third party, called the Dispute Resolution Body, which acts as an intermediary between both parties. This body is neutral and will negotiate with both parties to reach an agreement, and may ultimately suggest and/or impose a solution to the dispute.

CHANGES AND RETURNS

RIGHT OF WITHDRAWAL

The Customer has the right to withdraw from the purchase and return the purchased product(s) and/or change their size (except for the products described in the following point) without the need for justification within 30 calendar days from the date of receipt. If the products from the order are delivered separately on different dates, the date of receipt of the last product will apply for return purposes.

If the customer returns all products from their order within the first fourteen (14) calendar days from the receipt of the last product, they will be refunded all payments received after the purchase, including shipping costs.

If the customer decides to keep any product and, consequently, partially cancels their order, or returns the products after the fourteen (14) calendar days but within the referred 30 calendar days, only the price paid for the products will be refunded, and shipping costs will not be refunded.

To exercise the right of withdrawal, the customer must notify their decision via email at clientes@macson.es.

A) Conditions for Exchanges and/or Returns

Macson cannot accept exchanges or returns of used or damaged garments (unless it is a defect and/or quality or manufacturing flaw). For hygiene reasons, products such as underwear and face masks cannot be returned. Customized garments and accessories or those that have been altered cannot be exchanged or returned.

B) Conditions for Exchanges and/or Returns

Macson cannot accept exchanges or returns of used or damaged garments (unless it is a defect and/or quality or manufacturing flaw). For hygiene reasons, products such as underwear and face masks cannot be returned. Customized garments and accessories or those that have been altered cannot be exchanged or returned.

C) Free Returns

Returns are free as long as they are made in a physical store or dropped off at a collection point (Post Office) within the territory of the Peninsula and the Balearic Islands.

For returns with home collection, €3.95 will be deducted from the refund at the time of reimbursement.

For orders outside the peninsular territory and the Balearic Islands, exchanges and returns will be the customer's responsibility.

D) Timeframe to Receive Refund Amount

Once we have received the product, we will verify and approve that the returned products are in good condition and in the previously mentioned conditions (with original packaging, tags attached, and any accessories, in the same condition they were sent, without having been used, washed, or altered), except for any indicated defect or flaw.

If the return is approved, we will notify you via email with an approximate date for the refund amount. The timeframe may be affected by the banking process itself and will vary depending on the payment method and each bank.

If the refund amount is incorrect, you can contact our online customer service department via email at clientes@macson.es, and we will try to resolve it as soon as possible.

E) Procedure for Online Returns

To proceed with a return, you must click on the following link https://macson.shipping-portal.com/rp/ , which will redirect you to our returns platform. To manage a return, you must use the same email that was used for the purchase. Once you complete the steps on the platform, when we receive it and check its condition, we will proceed with the refund.

F) Procedure for Returns at Macson Stores

You can return garments in any of our stores under the conditions described above. The refund will be made in cash or to a credit card.

G) Specific Conditions for Returns on Promotions

In the case of returns on promotions, if the purchase amount minus the return does not exceed the amount established in the promotion, the discount or promotion applied at the time of the first purchase will be canceled.

H) Specific Conditions for Exchanges.

The customer has the possibility to exchange any of our products purchased through our online store. To do so, they must follow the return procedure, within the specified timeframes and conditions. Once the product has been returned, the customer must proceed with a new purchase for the desired size or color.

Customized garments and accessories cannot be exchanged or returned.

Additionally, customers can also exchange products for another size or color or for a different product in any of our MACSON physical stores, provided they are in the perfect conditions described above and are done within the specified 30-day period.

MACSON CLUB LOYALTY PROGRAM

To become part of Macson's loyalty program 'Club Macson,' users must register in advance through the form available on the website or in any of our physical stores.

By checking the box ‘I have read and accepted the privacy policy and terms of use’ during registration or by continuing to use any services of the program, the user confirms that they know the terms and conditions and agrees to be bound by them. If the user does not agree with these terms and conditions, they cannot participate in the loyalty program.

At Macson, we reserve the right to modify the terms and conditions at any time. Users will be notified of such changes either by email or through the website.

A) Registration

Any natural person with full legal capacity can request registration through the website or in any Macson physical store.

As long as the user accepts the Terms and Conditions when registering in one of our physical stores, to activate their account, they must verify their email through a link that will be sent to their email address. With this verification, the user will also be accepting the Terms and Conditions in question.

All information provided by the user during registration must be true, accurate, complete, and up-to-date. To verify the account, Macson may request additional verification information.

If Macson detects that the user is involved in any suspicious activity or has provided inaccurate or incomplete information during the registration process or afterward, which violates these terms and conditions, they may temporarily suspend the account until the cause of the suspension has been resolved. If the cause is not resolved, the account may be blocked, resulting in the loss of all advantages as well as any accumulated euros.

Users are responsible for maintaining the confidentiality of their account information and will immediately inform Macson of any unauthorized access and/or use of it.

B) Operating Rules of the Program

To access the advantages of the program, you must identify yourself in the physical store or online with the email you registered with.

*If you register in a physical store, to access online for the first time, you must create a new account with the same email provided in the store to synchronize your accounts.

In-store, the customer must identify themselves with the virtual Club Macson card downloaded on their mobile or identify themselves as a member each time they make a purchase in any of our Macson stores.

As a member of Club Macson, all purchases accumulate € discounts that will be credited to the customer's account.

For every euro spent at Macson, you accumulate €0.025, which will be registered in your account. Macson reserves the right to modify this value at any time, either upward or downward.

The accumulated € can be used in any Macson store in Spain and Andorra (physical and online) with an expiration of twelve months from the last purchase.

C) Check Accumulated €

You can check your accumulated € either in your account in the customer area of our website macson.es or by downloading your virtual Club Macson card on your mobile phone.

The expiration of the accumulated € will be twelve months from the last purchase made.

Each time you use the accumulated €, the member's balance will be reset to zero.

D) Withdrawal and/or Cancellation of the Program

Macson may revoke the subscription to the Club Macson loyalty program for any member in case of non-compliance with any of the assigned duties, if fraudulent or bad faith acts are detected, by notifying via email.

The member may also cancel their subscription to Club Macson at any time from:

  • The private area of their account on our website. Clicking on ‘commercial communications’. There, they can modify the communication channels, and if they deactivate the email, they will be automatically unsubscribed from Club Macson.

  • At the bottom of any of our email communications.

Either of the two methods will result in the loss of all accumulated € and benefits of the program and they will not be recovered in case of re-entry.

Macson reserves the right to cancel the CLUB MACSON program at any time and without justified reason.

E) Modification of Program Conditions

Macson may modify these conditions by communicating with Macson members, a requirement that the parties expressly agree is fulfilled by publishing the changes through macson.es and/or sales points.
